Bylaws

Bylaw is a rule or law established by an organization or community to regulate itself, as allowed or provided for by some higher authority. The higher authority, generally establishes the degree of control that the by-laws may exercise. By-laws may be established by entities such as a business corporation, a neighborhood association or depending on the jurisdiction, a municipality. The Port Crescent Land Company established the Huron Dunes Association as a non-profit corporation in 1958.

The Bylaw document was originally established and adopted in 1983. In 1960, the Port Crescent Land Company conveyed by deed all of the streets, lanes and park land to the Association. The following is a reproduction of the current Huron Dunes Association Bylaw document.

Deed Restrictions

Deed restrictions are private agreements that restrict the use of the real estate in some way, and are listed in the deed. Developers often restrict the parcels of property in a development to maintain a certain amount of uniformity.

The Port Crescent Land Company created Huron Dunes subdivision in 1949 when the plat was dedicated and recorded with the Huron County Registrar of Deeds. The plat laid out the boundaries of the lots, streets, lanes, and parks and dedicated the streets, lanes and parks to the use of the property owners. The developer also executed and recorded a seven paragraph document and these restrictions were included in each and every deed issued to the original lot owners and are referred to as deed restrictions. The first deed to a lot was issued on July 6, 1950.

Association Water System

Central Water System

Water service to the community is provided via a Central Water System.  The water system is fully regulated by the State of Michigan; Department of Environmental Quality (DEQ), and is classified as a Type I, the same level as Cities and Villages throughout the State.  As such, the water quality is tested monthly with an Annual Drinking Water Quality Report published (web link here) as well as distributed to each Association Member during the annual Spring Meeting.

As outlined in Article III, Powers and Duties of the Board of Trustees (Section II, subsection a), the Board is responsible for the management of the Central Water System.  In keeping with this responsibility, the Board, on behalf of the Association, employees a certified Water System Operator (WSO), Karl Krull, as mandated by the DEQ.

Each home in the community is connected to the Water System (presently, there are three (3) homes not connected), has an Association owned Curb Stop Shutoff on their property.  To ensure the integrity of our Water System only our WSO is authorized to turn on/off these Curb Stop Shutoffs.  Please contact Karl Krull directly if/whenever you wish to have your Curb Stop Shutoff turned. He can be reached at 989-550-4940.

IMPORTANT: Anyone who turns, or attempts to turn their Curb Stop Shutoffs is liable for any/all damage that may occur.

NOTE: These Curb Stops are not designed for long term (such as over the winter) shutoffs and Association Members are strongly urged to have their own separate self-draining shutoffs installed beyond the Association shut-off valve.

Water Report

Our water is routinely monitored for constituents according to Federal and State laws. Our annual report is designed to inform you about the quality of the water supplied to Huron Dunes Subdivision homes from our wells. Well #1, located behind 2924 Bay Drive is one hundred fifty five feet deep and Well #4, located approximately twenty feet from Well #1, is the same depth. Our Wells #2 and #3 are still online with acceptable traces of arsenic and can be used as a backup water supply. Currently they are being maintained, however, they are not being used as a primary water supply.

Our drinking water meets all federal and state requirements at this time and the report all homeowners were provided our water test results. The following PDFs show the results of our monitoring.

In the PDF reports, you may find terms and abbreviations you might not be familiar with. To help you better understand these terms we’ve provided the following definitions:

  • Non-Detects(ND) – laboratory analysis indicates that the constituent is not present.
  • Parts per million (ppm) or Milligrams per liter (mg/l) – one part per million corresponds to one minute in two years or a single penny in $10,000
  • Parts per billion(ppb) or Micrograms per liter – one part per billion corresponds to one minute in 2,000 years, or a single penny in $10,000,000.
  • Parts per trillion (ppt) or Nanograms per liter (nanograms/l) – one part per quadrillion corresponds to one minute in 2,000,000,000 years or one penny in $10,000,000,000,000.
  • Maximum Contaminant Level - The “Maximum Allowed” (MCL) is the highest level of a contaminant that is allowed in drinking water. MCLs are set as close to the MCLGs as feasible using the best available treatment technology.
  • Maximum Contaminant Level Goal – The “Goal” (MCLG) is the level of a contaminant in drinking water below which there is no known or expected risk to health. MCLGs allow for a margin of safety.
  • Action Level (AL) – the concentration of a contaminant which, when exceeded, triggers treatment or other requirements which a water system must follow.
